What is the withdrawal period after a sale agreement?
A buyer of a dwelling, if they are not a professional, benefits from a 10-day withdrawal period after notification of the sale agreement or unilateral promise (Article L.271-1 of the French Construction and Housing Code, CCH). During this period, they can withdraw without reason or penalty and recover their deposit.
A right reserved for the non-professional buyer
The 10-day withdrawal period is provided for by Article L.271-1 of the CCH. It benefits the non-professional buyer of a building used for residential purposes. The seller, on the other hand, does not have this right once committed.
During these 10 days, the buyer can withdraw freely, without having to justify themselves and without penalty: the sums paid (security deposit) must be returned to them, in principle within a period of 21 days.
Starting point of the period
The 10-day period runs from the day after the first presentation of the notification of the deed to the buyer (registered letter with acknowledgement of receipt, hand delivery, or electronic means under the conditions provided by law).
If the last day is a Saturday, a Sunday or a public holiday, the period is extended until the next working day.
