The 3 types of charges - law 65-557
1. General charges (art. 10 para. 1 of law 65-557)
Charges relating to the preservation, upkeep, and administration of the entire building. Allocated according to the general ownership shares (shares of common areas). Includes: building insurance, property manager fees, facade renovation, roofing, common stairwell.
2. Special charges (art. 10 para. 2)
Charges tied to a specific facility or service. Allocated according to the objective usefulness for each unit: elevator (based on floor), collective heating (based on heating shares), shared pool or garden.
3. Works fund (art. 14-2-1 of law 65-557, Climate and Resilience Act)
A mandatory contribution for any building wholly or partly used for housing, whatever the number of units, ten years after its completion (obligation in force since 2023, 2024 or 2025 depending on the size of the condominium). Minimum 5% of the annual provisional budget, and at least 2.5% of the works planned when a multi-year works plan has been adopted. Sums paid are attached to the unit and are not refunded to the seller upon sale.
Charges recoverable from the tenant
If the property is rented: decree 87-713 of August 26, 1987 lists the recoverable charges (heating, water, elevator, common area upkeep, household waste tax). The rest (facade renovation, property manager, works fund) remains the owner's responsibility.
